Terms and Conditions for Masterclasses and Bootcamps

1. Bookings

1.1 Your booking enters you into a binding contract with us. We are free to accept or decline your booking at our discretion.

1.2 . At the point of our confirmation, a contract will come into existence between you and Sharp Insight Ltd. The contract will continue until the completion of the course unless it is cancelled earlier per the cancellation terms.

2. Fees and Payment

2.1. The fees payable are published on the website.

2.2. Fees are listed and payable in GBP. If you are paying in a different currency, you are responsible for any additional transaction fees associated with an international payment.

2.3. In most cases payment in full is made at the time of booking.

2.4. For any courses where payment is required in instalments, payment deadlines must be met per the published dates. For specific course deadlines please refer to the individual course pages on the website.

2.5. Sharp Insight Ltd does not offer credit agreements. Therefore all payment plans must be made ahead of course activities and payment must be made in full before the first day of the course.

2.6. Sharp Insight Ltd reserves the right to withdraw the offer of a place if any outstanding course fees are not paid by the designated deadline.

2.7. From time to time Sharp Insight Ltd may offer promotional offers or discounts on short courses.

2.7.1. Only one discount may be claimed per student, per booking.

2.7.2. Discounts may be withdrawn at any time.

2.7.3 Discounts must be used at the time of booking and will not be applied retrospectively

3. Accuracy of Booking Data

3.1. By submitting your booking, you confirm that all information provided to Sharp Insight Ltd is correct. Sharp Insight Ltd reserves the right to review any booking if any information provided is found to be incorrect.

4. Cancellation and Refund Policy

4.1. Under the Consumer Rights Act 2015, you have a right to cancel your contract with us within 14 days of your (first) payment (known as a cooling-off period). If you wish to cancel your booking and request a refund, please send an email to chloe@sharp-insight.co.uk within 14 calendar days of the date of your (first) payment.

4.1.1. If the course begins during the 14-day cooling-off period, you will be liable for the course fees for any part of the course that takes place until we receive your written confirmation of cancellation.

4.2. After the 14-day cooling-off period expires (up until 14 calendar days before the start of a course), the following policies apply:

4.2.1. If written notification of cancellation by email to chloe@sharp-insight.co.uk is received no later than 14 calendar days before the start of the course, the course fees paid to date will be refunded, minus a 25% administration fee.

4.2.2. A full refund will be issued if a medical certificate or sufficient extenuating circumstances are provided. Extenuating circumstances will be at the discretion of Sharp Insight Ltd.

4.3. Within 14 calendar days of the start of the course the following policies apply:

4.3.1. If you cancel your place within 14 calendar days of the start of the course you must notify Sharp Insight Ltd by email to chloe@sharp-insight.co.uk. You will not be eligible for a refund.

4.3.2 Consideration of transferring funds to another course is at the discretion of Sharp Insight Ltd.

4.3.3. If you withdraw from a course for medical reasons, a partial refund may be issued if a medical certificate or sufficient extenuating circumstances are provided. Extenuating circumstances will be at the discretion of Sharp Insight Ltd .

4.3.4. If this falls within your 14-day cooling-off period please refer to 4.1.1.

4.4. For in-person events, we will not refund any travel or external accommodation you have purchased to attend a Course. We strongly advise you to purchase the appropriate insurance cover for any travel or accommodation booked prior to the course commencing. Travel/external accommodation costs will not be reimbursed, regardless of whether you cancel your contract, or we cancel the course.

4.5. Once the course has started:

4.5.1. In the event that you have to leave a course while the course has started due to illness (a medical certificate will be needed), Sharp Insight Ltd reserves the right to decide on the course fee amount that should be returned. This will be determined based on the number of days missed and if you can provide a medical certificate (or a positive COVID19 test result in the case of COVID-19).

4.5.2. Refunds are not available should you have a change in circumstances that makes continued attendance at the course difficult, or if you simply change your mind.

4.5.3. Non-attendance at classes due to reasons other than Sharp Insight Ltd’s default does not entitle you to refunds, or a transfer.

4.5.4. We will not refund any travel or external accommodation you have purchased to attend a Sharp Insight Ltd Course. We strongly advise you to purchase the appropriate insurance cover for any travel or accommodation booked prior to the course commencing. Travel/external accommodation costs will not be reimbursed, regardless of whether you

cancel your contract, or we cancel the course.

4.6. Where a refund is due:

4.6.1. We will process the refund according to the method of payment used to make the booking. If you request a refund more than six months after your booking, you will be required to send us your bank details. Under the GDPR, we cannot store this information for longer than six months.

4.7.2. Refunds will be paid in GBP. We are not responsible for any losses you suffer as a result of currency fluctuations.

4.7.3. Please allow 15 working days for a refund to reach your account.

5. Cancellation and Changes to Courses by Sharp Insight Ltd

5.1 Where possible we endeavour to run all our courses as advertised. However, Sharp Insight Ltd reserves the right to reschedule or cancel a course within 7 days of its start date. We reserve the right to reschedule or cancel courses. Reasons for this may include, but may not be restricted to, low enrolment numbers, weather warnings and tutor availability.

5.2. Should a course be unable to run we may cancel our contract, and we will endeavour to inform you no less than 7 calendar days before the course starts, in which case you can either:

5.3. Transfer onto an alternative course, subject to availability (and receive a partial refund of the course fees if the fees for the alternative course are less than the course fees you originally paid or be charged for the difference between the course fees if the alternative course is more expensive); or

5.4. Cancel the contract and receive a full refund of any course fees paid.

5.5. In the event of cancellation, Sharp Insight Ltd is not responsible for any additional costs you may have incurred, including costs for travel or external accommodation.

5.6. Refunds will be paid in GBP. We are not responsible for any losses you suffer as a result of currency fluctuations.

5.7. In the case of package bookings where only one of the two courses is cancelled, we will reimburse the difference between the full price of the course running and the package booking price.

5.8. We will endeavour to deliver the courses as publicised. However, we reserve the right to make changes to the course as follows:

5.8.1 Publicised course tutors and guest speakers (web and print form) may be subject to change.

5.8.2. The timetable for the delivery of the course may be subject to change.

5.8.3. Dates and locations for delivery of the course may be subject to change.

5.8.4. We may make changes to the course which are necessary to ensure it complies with any applicable laws or requirements.

5.8.5. In the event of any changes to the course, we will endeavour to give as much notice as possible.

5.9. In the event we are unable to run a session as part of a course, we will make every reasonable effort to either reschedule the session or extend the remaining sessions to cover the missing hours.

6. Our Right to End the Contract

6.1. We may end the contract if:

6.1.1 You do not make payment to us within your agreed payment plan schedule or in accordance with published payment deadlines.

6.2. If we end the contract due to any of the reasons outlined above, you will not be entitled to a refund.

7. Non-attendance

7.1 Non-attendance at classes due to reasons other than our default does not entitle participants to refunds or a transfer.

8. Online Short Courses (Masterclasses and Bootcamps)

8.1. In order to undertake an Online Course with Sharp Insight Ltd, you should be able to write and edit documents, send and receive email, find your way around online, download files and use online forums. You should also be aware of the essentials of computer security to keep your data and personal information safe. We will send out instructions on how to use any platform required to take part in the course.

8.2. Sharp Insight Ltd are not responsible for any technical problems you encounter due to your personal equipment or user error. We are unable to provide technical or content support other than that highlighted in the course information.

8.3. We will endeavour to ensure that online resources are accessible at all times throughout your online short course. However, we cannot guarantee uninterrupted availability, and may suspend access for the purpose of maintenance, upgrades or emergency repairs.

8.4. Participants agree that they will not record, reproduce, download, modify, re-publish, sublicense, sell, share, broadcast, transmit, make available, disseminate or distribute in any way any of the content provided as a part of their Online Short Course. Any redistribution or reproduction of part or all of the contents of the courses in any form is prohibited.

8.5. Participants may download and use Online Short Course materials where available, for their own personal, non-commercial use only.

8.6. When uploading material, participants must ensure that they are entitled to upload this material and that this does not infringe any rights or copyright law.

8.7. Participants will not upload or share with other students or tutors any material which is unlawful or unsuitable according to societal norms in the United Kingdom or our policies. This includes uploading of material that is false, obscene, sexist, racist, homophobic, defamatory, illegal, abusive, threatening, extremist, destructive (like malware, viruses, bugs, etc.) or otherwise discriminatory, offensive, disruptive or objectionable to others.

8.8. The Online Short Course materials may contain links or embedded links to third-party content and websites. These links are provided for your reference only and we do not endorse the content or the operations associated with them. We have no control over such content and cannot accept any liability for such third-party content. You should be aware that accessing such content will be subject to third-party terms of use and privacy policies.

8.9. Online courses consist of live sessions and are not recorded. Recordings of sessions may be arranged for reference purposes only but this is at the discretion of the Open Programmes Team and the tutor(s).

9. Complaints

9.1. If you have any complaints about the services, you should raise this by contacting Sharp Insight Ltd.

10. Use of Data

10.1. You agree to Sharp Insight Ltd processing personal data contained in your booking form, or other data which the School may obtain from you or other people,

for purposes connected with your course, health and safety or for any other legitimate reason.

10.2. Sharp Insight Ltd is committed to upholding your privacy and taking care with the personal information that you may give us. From 25 May 2018, we process your personal data in accordance with the General Data Protection Regulations (or GDPR for short). Sharp Insight Ltd will process personal data contained in this form or otherwise supplied by yourself or other people, for purposes connected with your course, your health and safety, or for any other legitimate reason connected to your studies.

11. Photographic and Video Consent

11.1. We use and retain photographs and videos of participants of all ages from our courses for promotional purposes. By giving us your consent in the course application form, you agree to let us use photograph(s) and video(s) of your participation in the course, for publicity for Sharp Insight Ltd.

11.2. Photographs and video taken during courses, events, rehearsals, productions and concerts may be used by the School for publicity purposes. All photographs, video and audio remain the property of the Sharp Insight Ltd.

11.3. Any personal photographs or video recordings you take during your course are strictly for private use and must not, under any circumstances, be posted on the internet or be used publicly in any way.

11.4. Online sessions may be recorded for reference purposes only and will not be shared outside of your course.
